Atlanta has had a short-term rental license since 2021, and for most of that time it went unenforced. In September 2026 the council removed the rule that limited each host to a primary residence and one other unit, effective January 1, 2027, and enforcement is expected to start the same year. From 2027 a tenant-operator can get the license with the owner's signature, and the 31-night line keeps mid-term stays outside it entirely.
This page covers what the license means for Airbnb arbitrage, what a two-bedroom costs and rents for furnished, who books 31+ night stays, where landlords are likeliest to say yes, and the Atlanta-specific ways a deal goes wrong. The licensing details rest on independent sources quoting the city's page and on coverage of the council votes, checked on the date shown above.
Is rental arbitrage legal in Atlanta?
Yes, with a city license for nightly stays and the landlord's written consent. Ordinance 20-O-1656, adopted in March 2021 and codified in the Land Development Code, defines a short-term rental as a stay of 30 consecutive days or less. Each unit needs a Short-Term Rental License: $150 a year, nonrefundable, renewed every 12 months, with the license number on every listing and a local agent reachable around the clock.
The applicant can be the owner, a long-term tenant or an authorized agent. A tenant needs a notarized affidavit and the landlord's permission, and a unit in a multifamily building needs a signed affidavit from the building owner or manager; HOA and condo rules still apply. Through December 31, 2026, one host can license only a primary residence and one other unit, so a non-resident operator has no license path today. On September 21, 2026 the council voted 9-5 to delete that cap from January 1, 2027, after the city's Department of Law said the residency rule had been "the subject of successful challenge in other jurisdictions." The affidavits stay. Penalties on paper: $500 per violation, each day separate; revocation after three violations in 12 months; and a one-year bar on applying if caught unlicensed.
Stays of 31 nights or more are outside the license, the 8% city hotel-motel tax and the $5-a-night state fee. Note the 31: a 30-night booking is still a short-term rental here (unlike Houston, where 30 is the line). One vendor guide says Georgia sales tax still applies to reservations of 89 nights or fewer, so confirm that with your accountant before you price a 31–89 night stay.
| Stay length | City license | Taxes and fees | What the landlord must sign |
|---|---|---|---|
| 30 nights or less | Required: $150/yr, number on every listing; through Dec 31, 2026 limited to a primary residence + one unit | 8% city hotel-motel + 8.9% sales tax + $5/night state fee; Airbnb collects all three | Notarized affidavit with landlord permission; building owner/manager affidavit in multifamily |
| 31–89 nights | Not required | No hotel-motel tax or $5 fee; sales tax may still apply (vendor reading, verify) | Written consent to re-rent (O.C.G.A. 44-7-1) |
| 90+ nights | Not required | None | Written consent to re-rent (O.C.G.A. 44-7-1) |
What does an Atlanta 2-bedroom cost, and what does it rent for furnished?
It depends which index you read. Zumper's October 29, 2026 citywide 2BR median is $2,007, flat on the year; Apartment List's November 2026 figure is $1,540, up 0.3%. Apartment List's sample includes more older buildings, while Zumper's skews newer. Rental Beast's Q2 2026 metro 2BR median sits between them at $1,684.
Furnished rates are listing asks, not closed deals. On CorporateHousing.com, two Landing units on the Peachtree corridor ask $2,611 and $2,779 for a two-bedroom, and other corporate housing 2BRs downtown and in Buckhead ask $3,373 to $4,497. A Furnished Finder 2BR aimed at travel nurses asks $3,200 with a three-to-six-month minimum, and a Druid Hills 2BR near Emory marketed to medical staff asks from $2,495. A working range for an in-town furnished two-bedroom is $2,500 to $3,400 a month. The top-performing units ask about $4,200 to $4,700, and what they share is two baths, turnkey furnishing in a full-amenity Midtown or Buckhead high-rise (gym, pool, concierge), a one-month minimum, and the nearby hospital named in the listing title; these are asks, not earned rates.
For nightly stays, vendor estimates run from a $172 to a $202 average daily rate at 36% to 55% occupancy; methods differ widely.

Does the math work in Atlanta?
Only with a lower rent or a top-of-range rate. We ran four two-bedroom scenarios through our Deal Analyzer with its default assumptions: 85% occupancy, 90-night stays, $150 per turnover, 3% platform fees, $365 a month for utilities, insurance and supplies, $5,000 per bedroom to furnish, a deposit equal to one month's rent, and $800 to source the unit.
At Zumper's $2,007 median and a $3,000 furnished rate, the unit nets about $50 a month at 83% break-even occupancy, a payback of roughly 25 years. Nobody should sign that. The concession scenario uses $1,790, about 11% under the median: 51.8% of listings offered a concession in Q2 2026, and one to two free months spread over a year takes 8% to 17% off the rent. That nets about $270 a month at 75% break-even. Holding the median rent but reaching $3,400, the top of the in-town range, nets about $380 a month at 73% break-even with a 40-month payback.
The quick test: the furnished rate should be about twice the rent. Against $2,007 that is about $4,000, which only the priciest corporate units ask; against older stock near $1,540 it is about $3,080, inside the observed range. The deal usually lives in an older building, not a new tower at list price. The exception is a top-performing unit: at the median rent, a $4,200 rate clears the 2× test and nets about $1,040 a month at 59% break-even, a 15-month payback, but that takes a two-bath, turnkey unit in a full-amenity Midtown or Buckhead high-rise, and $4,200 is a listing ask, not an earned rate. Those buildings usually rent above the citywide median: at Buckhead's $2,450 average 2BR rent (RentHop), the same rate nets about $600 a month at 70% break-even.
| Scenario | Rent | Furnished rate | Net / month | Break-even occupancy | Payback |
|---|---|---|---|---|---|
| Citywide median, mid rate | $2,007 | $3,000 | $52 | 83% (thin) | 297 months |
| Concession rent, mid rate | $1,790 | $3,000 | $268 | 75% (workable) | 55 months |
| Median rent, top of in-town range | $2,007 | $3,400 | $381 | 73% (workable) | 40 months |
| Median rent, top-performing rate | $2,007 | $4,200 | $1,041 | 59% (strong) | 15 months |
Who books 31+ night stays in Atlanta?
Hospital staff, first. Piedmont Healthcare employs 29,646 people and Grady 7,274 (Metro Atlanta Chamber, 2025), and Emory University Hospital Midtown shows up in current travel-nurse postings paying $1,822 to $2,170 a week. Atrium Health and Morehouse School of Medicine announced a $700 million teaching hospital for southwest Atlanta in August 2026, starting at 50 beds and growing to 700, with no opening date yet; construction and ramp-up staff will need housing.
Corporate relocation is the second pool. Delta (42,090 jobs), UPS (17,037), Coca-Cola (4,100) and Georgia Tech (9,389) bring project and relocation staff for one to six months in Midtown, Buckhead and near the airport. Film is a smaller draw than it was: statewide production spending fell from more than $4 billion in 2022 to $2 billion in fiscal 2026. Super Bowl LXII at Mercedes-Benz Stadium on February 13, 2028 will add a spike.
Where will Atlanta landlords say yes?
In buildings still digesting the 2023–24 supply wave. Atlanta delivered 24,443 apartments in 2024; 2026 deliveries are projected to fall about 43% to roughly 9,300, with 18,191 units under construction in Q3 2026. Concessions are shrinking fast (51.8% of listings in Q2 2026, down from 61.2% in Q1, the quickest pullback in the country). Matthews puts metro vacancy at 5.7% in Q3 2026, from 4.4% in Roswell/Alpharetta to 6.2% in South Fulton and 6.8% in the far east suburbs.
Owner distress helps the pitch: foreclosures are rising, many 2021–22 buyers are underwater, and the operators named at Bisnow's 2026 Atlanta summit include Cortland, RangeWater, Portman Residential, Woodfield, Willow Bridge and Atlantic Pacific. A lease-up or distressed owner is the landlord our finding-properties guide tells you to call first; bring a corporate guarantee, because screening has tightened after a wave of application fraud. Single-family is harder: institutional investors own about 72,000 metro homes by one advocacy group's count, and their leases generally bar subletting, so single-family arbitrage here means small owners.
Which Atlanta neighborhoods should you target?
Start near the hospitals and employers, where furnished demand already exists.
| Area | Data point | Why it works |
|---|---|---|
| Midtown | 5.0% vacancy; furnished 2BR asks $2,611–2,779 | Emory Midtown and Georgia Tech |
| Decatur / Druid Hills / Emory | Named in travel-nurse housing guides | Emory University Hospital and the CDC |
| Downtown / Castleberry Hill | Corporate 2BR asks $3,373–4,497 (with Buckhead) | Grady, Georgia State, the convention center, the 2028 Super Bowl; avoid STR-saturated condos |
| Old Fourth Ward / Inman Park / Beltline | Average rent $2,362 (Zumper) | Strong furnished demand |
| Lindbergh / south Buckhead | Lindbergh-Morosgo $1,801 (Zumper) | Piedmont Atlanta Hospital; among the cheapest in-town rents |
| East Point / Hapeville / South Fulton | 6.2% vacancy, rents +7% YoY (South Fulton) | Airport and Delta workforce |
What goes wrong in Atlanta?
Licensing timing. Until January 1, 2027 a non-resident operator has no nightly license path; after that, both affidavits still apply. Enforcement has been thin (about 2,200 applications by May 2025 while thousands operated unlicensed, and AirROI found a permit number on 9% of 5,990 active listings in October 2026), but it is expected to start in 2027. Don't build a plan on the old gap.
Consent and concessions. Re-renting without written landlord consent violates O.C.G.A. 44-7-1 and puts your lease at risk. Leases with one or two free months usually require you to repay them if you break the lease early.
Neighborhood bans and condos. The council banned new short-term rentals in Home Park, next to Georgia Tech, on August 18, 2025 (existing licenses were grandfathered), and a District 7 ban covering north Buckhead and Lindbergh failed 7-6 on November 17, 2025. More district bans are likely, and a pending rewrite would add 1,000-foot spacing and a 10% cap on STR units in multifamily buildings of 10 or more. The Landmark Condominium downtown, where 50 LLCs control more than 90 of 200 units, is the case behind that cap. Georgia condo law generally needs a two-thirds owner vote to ban short-term leasing, so read the declaration before you lease a condo.
The 30-night trap. Set minimums at 31 nights. The state's $5 fee counts continuous occupancy, so a guest who checks out and back in restarts the count. Outside Midtown and downtown, plan for guests with cars.
Frequently asked questions
Do I need an Atlanta short-term rental license if every stay is 31 nights or longer?
No. The ordinance covers stays of 30 consecutive days or less, so a 30-night booking still counts. A unit rented only for 31+ night furnished stays needs no city license and owes no 8% hotel-motel tax or $5 state fee, though one vendor guide says sales tax applies up to 89 nights. Your lease still has to permit the use.
Can a tenant, not the owner, get a short-term rental license in Atlanta?
Yes. A long-term tenant can apply with a notarized affidavit and the landlord's permission, plus a building owner or manager affidavit in a multifamily building. Until January 1, 2027 a host can license only a primary residence and one other unit; the council has voted to remove that cap, but the affidavits stay.
What taxes apply to short stays in Atlanta?
On stays of 30 nights or less: the city's 8% hotel-motel tax, 8.9% sales tax (4% state, 4.9% local) and Georgia's $5-a-night hotel-motel fee. Airbnb collects all three, but hosts still register with the Georgia Department of Revenue and file returns. Stays of 31+ nights are outside the hotel-motel tax and the $5 fee.
Is rental arbitrage legal in Georgia?
Georgia has no statewide short-term rental license, and we found no law preempting city rules; HB 1121 (2024), which would have barred local limits on existing rentals, did not pass. What state law does require is landlord consent: under O.C.G.A. 44-7-1 a tenant's right of use may not be conveyed without it. Each city sets its own licensing rules, so check the ordinance where the unit is.
Is Atlanta a good city for rental arbitrage?
For mid-term, yes, if you buy the rent right. The hospital systems and corporate relocations fill 31+ night stays, and owners still working through the 2023–24 supply wave are open to corporate leases. At Zumper's $2,007 median the margin is close to zero, so the deal depends on a concession or older-stock rent, or a top-of-range rate near $3,400 for a two-bedroom.
