Rental Arbitrage in Nashville, TN: Rules, Rents and Landlords

By the NestNights operator team · Rules checked 2026-10-29 · Updated 2026-10-29

Nashville has more than 11,000 advertised short-term rentals and only about 7,000 permits, and it is one of the least friendly big cities for Airbnb arbitrage. Metro moved non-owner-occupied rentals out of residential zones in 2018, ties every permit to the owner of record, and in 2026 is sending warning letters and getting unpermitted listings pulled from Airbnb.

This page covers what the permit rules mean for a tenant-operator, what a two-bedroom costs and rents for furnished, who books 31+ night stays, where landlords are likeliest to approve a corporate lease, and the Nashville-specific ways a deal goes wrong. Every figure is cited and the rules were checked on the date shown above.

Is rental arbitrage legal in Nashville?

For nightly stays, only if the owner holds the permit; for furnished stays of 31 nights or more, yes, with the landlord's written consent. Under Metro Code § 6.28.030, anyone listing a short-term rental property (STRP) "must receive a permit from the Metro Codes Department prior to listing." Permits are annual, stays must be at least 24 hours, and "the maximum stay for any guest shall be thirty consecutive days."

There are two permit types. Owner-occupied permits require an owner who "must permanently reside at the property and be a natural person," which rules out an arbitrage tenant. Non-owner-occupied permits are issued only in mixed-use, office, commercial and downtown districts (MUN, MUL, MUG, MUI, OG, OR20–OR40, ORI, CN, CL, CS, CA, CF, DTC, SCN, SCC, SCR); "new not owner-occupied permits are not permitted in AR2A, R, RS, or RM zoned properties." That phase-out dates to BL2017-608, effective February 2, 2018. Check any address in Metro's Permit Eligibility Viewer before you talk to a landlord.

The application must match the recorded deed, neighbor notices must be "signed by the owner (not a tenant)," and a non-owner may apply or operate only under a notarized Owner Authorization Form. The owner also supplies $1 million per-occurrence liability cover and an inspection. Tennessee's Short-Term Rental Unit Act (T.C.A. § 13-7-601 et seq.) lets Metro permit and suspend rentals and preserves lease, HOA and condo bans.

Stays over 30 consecutive days are not an STRP use, so a mid-term rental lease should run 31 nights or more. A 2025 state change (Public Chapter 364) has been reported to apply local occupancy tax to the first 30 days of any stay; that is reported, not confirmed, so confirm with the county before you price a 31+ night stay without tax. Davidson County is covered by the Uniform Residential Landlord and Tenant Act, which gives a tenant no right to sublet, so get the landlord's consent in writing.

What does a Nashville 2-bedroom cost, and what does it rent for furnished?

Rents are drifting down, and the indexes disagree on the level. Zumper's October 2026 average for a two-bedroom is $1,846 (down 3% in a year); Apartment List's November 2026 median is $1,356 (citywide rents down 2.0%). The gap matters for the math below.

No citywide index of furnished 30+ night rates exists, so this range is built from listing asks, not closed deals. A furnished 2BR condo in Madison asks $1,975 month-to-month; furnished two-bedroom houses on HouseStay ask $2,783 to $3,308. A working range of about $2,000 to $3,300 a month for a mid-priced furnished two-bedroom is defensible; plan on the low end unless comparable listings nearby ask more. The top-performing two-bedrooms ask about $3,500 to $4,000, up to $4,400 all-inclusive, and share the same traits: walking distance to VUMC in Midtown or Hillsboro Village (or a new Nashville Yards tower), utilities and Wi-Fi in the rent, a 1-month minimum, parking, in-unit laundry and usually two baths. These are listing asks from a small sample, not booked rates.

For nightly stays, a vendor estimate puts the average daily rate at about $363 and occupancy at about 43% in the year to September 2026. Those figures only matter if your landlord will hold a permit.

Does the math work in Nashville?

Not at the citywide average rent; it works only with a rent discount or a top-of-range rate. We ran four two-bedroom scenarios through our Deal Analyzer with its default assumptions: 85% occupancy, 90-night stays, $150 per turnover, 3% platform fees, $365 a month for utilities, insurance and supplies, $5,000 per bedroom to furnish, a deposit equal to one month's rent, and $800 to source the unit.

At Zumper's $1,846 average and a mid-range $2,650 furnished rate, the unit loses about $80 a month and needs 88% occupancy to break even. Take the rent down to $1,650, about 11% lower (a free month on a 12-month lease is worth about 8%, and 47% of Nashville communities offer at least one), and it nets about $120 a month at 80% break-even, a ten-year payback. Hold the $1,846 rent but get $3,300, the top of the observed range, and it nets about $460 a month at 70% break-even with a 33-month payback.

The quick test is that the furnished rate should be about twice the rent. Against a $1,846 lease that means roughly $3,700, above every typical two-bedroom ask we found but inside the $3,500–4,000 the best-located units ask. At $3,800 the average-rent unit nets about $870 a month at 61% break-even with a 17-month payback, the only full-rent scenario that clears the 2× test. Getting that rate takes a unit within walking distance of VUMC with utilities and Wi-Fi included, parking, in-unit laundry and a 1-month minimum, and $3,800 is an ask from a small sample, not a booked rate. Against Apartment List's $1,356 median it means about $2,700: at that rent and a $2,650 rate the model nets about $410 a month at 68% break-even. In Nashville the deal is in older and budget stock and in concessions, not in new buildings at full price.

Who books 30+ night stays in Nashville?

Healthcare first. Vanderbilt University Medical Center in Midtown, among Davidson County's largest employers, brings a steady flow of travel nurses, residents and visiting fellows. HCA Healthcare is headquartered in Nashville, with 189 hospitals and more than 320,000 employees company-wide as of March 2026; its TriStar hospitals and corporate campus bring contract clinicians and IT and finance rotations. Ascension Saint Thomas Midtown adds travel-nurse demand in the same corridor.

Oracle is the relocation story. It broke ground on its East Bank campus in May 2026, has pledged 2,500 Nashville jobs by the end of 2027 and 8,500 by 2030, and has leased 2,000 seats in the Neuhoff District in Germantown. Only 827 new local jobs were reported through 2025, so most hiring, and most demand for furnished landing pads, is still ahead. The new Nissan Stadium opens in 2027 and CMA Fest (June 10–13, 2027; about 100,000 fans a day in 2026) moves there: construction crews now, event staff later. Insurer-placed families after floods are a recurring channel too; the May 2010 Cumberland River flood showed the exposure.

Where will Nashville landlords say yes?

Nashville is a renter's market, which helps anyone pitching a corporate housing lease. Apartment List puts multifamily vacancy at 8.5% (August 2026), rents down 3.6% in a year, and 47% of communities offering at least one free month against a 31% national average, with roughly 10,000 units still in the pipeline. Northmarq has Downtown at 9.4% vacancy in Q1 2026, with deliveries still outpacing absorption.

Buildings still offering concessions, downtown above all, are the likeliest yes for a 31+ night furnished sublease: they are measuring vacancy cost every week, which is the landlord our finding-properties guide tells you to call first. Nightly use asks far more: the owner applies, insures, passes inspection and signs a notarized authorization, and only outside residential zoning. Pitch the 31+ night lease and leave nightly to owners who already hold a permit.

Which Nashville neighborhoods should you target?

Start near the hospitals and Oracle, where rents are still mid-range. Rents are Zumper's October 2026 neighborhood averages where available.

What goes wrong in Nashville?

The permit is the owner's. If the landlord won't apply, insure and sign the authorization, there is no nightly business. A grandfathered residential permit is non-transferable: if the building sells, the short-term use ends.

The 30-night line. A 30-night booking is still a short-term rental under the permit rules, so write mid-term leases at 31 nights or more. The 2025 state change taxing the first 30 days of longer stays is reported; confirm with the county before you quote a tax-free monthly rate.

Enforcement is complaint-driven and getting sharper. Metro's open-data roll listed 7,012 permits on October 16, 2026, against 11,000+ advertised rentals. Metro mailed 14 warning notices in the week of October 11, 2026, mostly in Council Districts 5 and 21 near downtown, and in September had an East Nashville listing delisted by Airbnb. Courts can reportedly fine $50 a day, and operating without a permit brings a one-year bar on getting one (three years after a court finding).

Buildings and weather. State law protects HOA and condo bans, so read the declaration before you sign. Flood risk is real along the Cumberland and its tributaries: check the FEMA flood zone and carry contents cover. Concessions will fade as vacancy tightens, so lock in 18- to 24-month terms while they last.

Frequently asked questions

Do I need a Metro permit if every stay is 31 nights or longer?

No. Metro's STRP rules cap a guest's stay at 30 consecutive days, so a stay of 31+ nights is not an STRP use and needs no permit. Your lease still has to allow it in writing. A 2025 state change reportedly applies occupancy tax to the first 30 days of longer stays; confirm with the county.

Can a tenant, not the owner, get a short-term rental permit in Nashville?

No. The application must match the recorded deed, and a tenant can only operate under the owner's notarized Owner Authorization Form. New non-owner-occupied permits are limited to mixed-use, office, commercial and downtown districts.

What taxes apply to short stays in Nashville?

About 16.75% plus $2.50 a night on stays of up to 30 nights: 7% state sales tax, 2.25% local option, a 0.5% transit surcharge and Metro's 7% hotel occupancy tax. Airbnb collects state sales and local occupancy taxes for its hosts, and Metro accepts that remittance; direct bookings mean filing yourself.

Is rental arbitrage legal in Tennessee?

No state law bans it. The Short-Term Rental Unit Act lets cities permit and suspend short-term rentals and preserves lease, HOA and condo restrictions, and in the larger counties the landlord-tenant act gives tenants no right to sublet. So it comes down to the city's permit rules and your landlord's written consent.

Is Nashville a good city for rental arbitrage?

For nightly stays, rarely: the owner must hold the permit and residential zoning is closed to new non-owner permits. For mid-term, yes, in the right units: hospital and Oracle demand is deep and 47% of communities offer concessions, but the rent has to sit near half the furnished rate.
